This website has been developed for use by customers and intended customers.
You agree not to use the website in any way that causes or is intended to cause access to the website to be damaged, interrupted, or impaired in anyway including but not limited to:
- Causing annoyance or nuisance inconvenience or mischief;
- Fraudulent purposes or in connection with unlawful or criminal activity;
- Breach of copyright, trademarks, confidence, privacy or any other right.
Contract
When you place an order to purchase a product from Sunburn, we will send you an email confirming receipt and details of your order.
Our acceptance of this offer to purchase will be at the time we dispatch that product to you and a confirming email in this regard is sent.
The acceptance will be complete at this time. It is agreed at the time you place an order it is your intention to enter into a contract with Sunburn Co Pty Limited.
Pricing and Availability
Sunburn lists products for sale on its website as indicated. Whilst we use our best endeavors to fulfill such orders, we cannot be held responsible if the products are not available at a given point in time.
It is further noted that dispatch times indicated on our website are a guide and are not guaranteed dispatch times and should not be relied upon as such.
Pricing is shown in the currency as indicated at the time the order is accepted, and all prices are inclusive of the Goods and Services Tax.
Customs
When ordering goods from sunburn.com.au for delivery to any destination outside Australia, the recipient may be charged import duty and other taxes including, but not limited to, sales tax which are levied on import values above a threshold by the customs authority in that overseas country. It is the responsibility of the purchaser to pay these amounts to the freight company if applicable prior to delivery. It is outside our area of control and responsibility to determine, advise or influence such charges.
As customs policies vary from country to country, you are requested to direct queries of this nature to your local customs office. Customers should also note that the recipient is to be regarded as the Importer of record and you will need to comply with whatever regulations are required in this regard in the country of the recipient. Sunburn are neither able to advise on process to claim back, nor refund, any duty and taxes paid should an ordered item be returned.
Consent
Sunburn.com.au assumes all sales are made to persons over the age of 18. If you are under 18, you need to have the involvement of a parent or guardian.
Payment
Payment is only accepted by means of the credit card types shown and Paypal. We are unable to process any other payment form.
Alterations to terms and conditions
We reserve the right to make changes to our website, policies, terms and conditions at any time.
Waiver
Should you breach any terms or conditions and we take no action against you, we shall be entitled to invoke our rights and remedies in any other situation where you breach these conditions.
Governing Law
The above terms and conditions are governed by the laws applicable of the state of New South Wales in Australia.
Both parties submit to the non exclusive jurisdiction of the New South Wales Courts.
1. Instructions on how to enter form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these conditions of Entry. The promotion is open to all residents of Australia except employees of the promoter, members of their immediate families and agencies associated with the promotion.
2. Entrants must be of 16 years of age or older.
3. The Promotion commences at 12.01am AEST 28/10/2011 and closes at 11.59 pm AEST on 01/03/2012. The judging will take place at the promoters premises. Judging will begin at 12.00pm AEST on 02/03/2012 at 247 King Street, Mascot NSW 2020 with the Winner, Runner Up and 10 shortlisted People's Coice Award contestants announced on 09/03/2012. The Winner, Runner Up and 10 shortlisted People's Choice award contestants will be contacted by phone or e-mail, using the details provided at the time of entry. The Winner will be asked to confirm their name, address and their ability to travel during the time frame specified by Sunburn and their mail details in order for prize to be delivered. Announcement of the Winner, Runner Up and 10 shortlisted People's Choice Award contestant names will be made via an e-newsletter to the Sunburn database, on www.sunburn.com.au and the Sunburn Swimwear Facebook page.
6. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on creative merit of their entry.

8. The promoter reserves the right , at any time, to verify the validity of entries and entrants (including the winners identity, age, place of residence and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process.) Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Incomplete , illegible and incomprehensible entries will be deemed invalid and will not be included in the judging.
10. The best entry as determined by the judges will win the major prize pack valued at $ 2500.00 + The winning swimsuit design to be created and sold throughout the national chain of “Sunburn” retail stores with the winners name featured on the swing tag. All proceeds of the sales from the winning swimsuit go to Sunburn and not the designer.
The Winner will also win two days in the life of a swimwear designer working with the Sunburn and Seafolly production team behind the scenes on getting the winning design entry ready for production.
The Winner will also win a beach weekend away including two nights’ accommodation for the winner and guest. Should the winner be 16 or 17 years of age, their guest must be an accompanying parent or guardian, if not an alternate prize to the same value will be offered. If the winner’s home address is 150kms or more from the Sydney CBD, the weekend away will be at Bondi Beach for the winner and their guest, which will then coincide with the 2 days as a life in the day of a designer located in Mascot at the promoters premises for the winner only. Should the winner live within 150kms of Sydney CBD then you will make your own way to Mascot, the promoters premises, to live out 2 days in the life of a swimwear designer and then will be flown to Ballina for a beach weekend away at Byron Bay for the winner and their guest.

11. If any prize ( or part of any prize) is unavailable , the Promoter , in its discretion , reserves the right to substitute the prize ( or part of the prize) with a prize to the equal value and/ or specification.
12. If this promotion is interfered with in anyway or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right , in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend , terminate or cancel the promotion, as appropriate.
13. Except for any liability that cannot be excluded by law, the Promoter ( including its officers employees and agents ) excludes all liability( including negligence) for any personal injury , or any loss or damage ( including loss of opportunity) whether direct , indirect , special or consequential , arising in any way out of the Promotion, including, but not limited to, where arising out of the following:(a) any technical difficulties or equipment malfunction ( whether or not under the Promoters control) ( b) any theft , unauthorised access or third party interference (c) any entry or prize claim that is late , lost , altered , damaged or misdirected ( whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters ( d) any variation in prize value to that stated in these Conditions of Entry ( e) any tax liability incurred by a winner or entrant (f) redemption of the prize and / or (g) participation in the promotion. All entries become the intellectual property of the Promoter and are available for use at their discretion, for any purpose.
14. Prizes are valued in Australian Dollars. Prizes values mentioned are the recommended retail value as provided by the supplier and are correct at the time of printing.
15. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. Each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant which does not infringe the rights ( including copyright) of any third party. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The promoter is entitled to use any of the entries submitted for any purposes at its discretion, including (but not limited) for any future promotion, marketing and publicity purposes. Where the entrant warrants that it has attributed the source and / or owner in its entry.
16. By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the promoter’s products, services and events and to promote third party goods and services it may be interested in.

Sunburn Beach Club Loyalty Program
Individuals who join the Sunburn Loyalty Program and/or redeem rewards agree to be legally bound by the Terms and Conditions.
The most current Terms and Conditions at any point in time can be found on the member website.
The Terms and Conditions may be modified at any time without prior notification by Sunburn in its absolute discretion. Despite anything to the contrary contained in this document, any modification to the Terms and Conditions may be applicable to a Member retrospectively.
Sunburn will not accept any liability for any email communication to any Member that is misdirected, lost or not received.
Sunburn will not accept any liability for any technical issues that may cause damage to any computer related to or used in connection with the Sunburn Loyalty Program.
Sunburn may collect personal information from the Members for the purpose of facilitating the Sunburn Loyalty Program. Please see Sunburn’s Privacy Policy on http://www.sunburn.com.au for more information.
In its absolute discretion, Sunburn reserves the right to cancel, terminate, modify or suspend the Sunburn Loyalty Program at any time.
Sunburn will not be liable for any tax liability incurred by a Member in connection with the Sunburn Loyalty Program, including that incurred in the provision of rewards.
The Terms and Conditions are to be read in conjunction with any additional conditions associated with Rewards. In the event of any discrepancies, Sunburn’s decision in its absolute discretion will be final and binding.
Sunburn’s decision in relation to all matters arising in relation to the Sunburn Loyalty Program is final and binding.
Definitions
1. "Benefits" means any benefits given to the Members.
2. "Member" means individuals who sign up to the Sunburn Loyalty Program.
3. "Member Webpage" refers to the web page where details of the Sunburn Loyalty Program (including the most up to date Terms and Conditions) can be found.
4. "Redeem Rewards" means Members can redeem rewards against purchases.
5. "Rewards" refers to rewards given to Members as a consequence of purchasing behaviors, incentives and/or promotions. Members are notified of Rewards via email.
6. "Technical Issues" means the technical malfunction of any telephone network, connection or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site or intranet site.
7. "Sunburn Card" refers to the membership card that is linked to the Members' account
8. "Terms and Conditions" mean the Terms and Conditions set out in this agreement and as updated on the Member webpage from time to time.
9. "Sunburn Loyalty Program" means the loyalty program operated by Sunburn providing Members with access to exclusive benefits and rewards.
10. "Sunburn" means Sunburn Pty Ltd ABN 26 133 111 583 or its authorised representatives.
Members | Membership
1. An individual is deemed to be a Member of the Sunburn Loyalty Program when they sign up and activate their Sunburn Card.
2. Activation of the Sunburn Card is deemed acceptance by the Member of the Terms and Conditions.
3. Membership of the Sunburn Loyalty Program is only open to individuals with a valid email address, postal address and mobile number.
4. At any time, Members can only have one membership to the Sunburn Loyalty Program and one corresponding Sunburn Card.
5. Sunburn reserves the right to refuse or terminate membership of the Sunburn Loyalty Program without prior notice or reason and in its absolute discretion.
6. Membership is not transferable.
7. A Member can at anytime terminate their membership by providing written notice to Sunburn.
Sunburn Card
1. The Sunburn Card remains the property of Sunburn at all times.
2. One Sunburn Card will be issued per Member.
3. A current Sunburn Card must be presented by the individual named on the Sunburn Card for all transactions including (but not limited to) requests for discounts, recording of purchases, redeeming rewards or in response to any promotional activity specific to the Sunburn Loyalty Program.
4. Members may be required to provide photo identification to verify their identity.
5. Only one Sunburn Card can be presented for each transaction.
6. A purchase must be made for a customer to be eligible to join the Sunburn Loyalty Program.
8. Sunburn Cards do not have an expiration date. Membership is valid for the lifetime of the program.
Benefits
1. Members of the Sunburn Loyalty Program will be entitled to receive benefits.
2. Sunburn reserves the right to vary the benefits at any time and without notice.
Reward
1. At its sole discretion, Sunburn may update a Member account with a reward as a consequence of a purchasing behavior, incentive and/or promotional activities.
2. Sunburn will notify the Member via email or post of their entitlement to any rewards.
3. Sunburn reserves the right to withdraw, cancel or vary the rewards without notice and at any time.
4. Rewards cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments - including (but not limited to) gift vouchers, gift cards, cheques and credit notes.
5. All rewards are based on the current exchange rate of the AUD
6. Sunburn reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed using rewards.
7. If a Membership is terminated from the Sunburn Loyalty Program, all outstanding and future rewards will no longer be valid and will be rendered null and void.
8. Rewards can take up to 48 hours before they are available for redemption.
9. All rewards have an expiry date and at which point they will no longer be available for redemption.
10. Only rewards from one Sunburn Card can be presented per transaction.
11. Sunburn will not be held responsible or liable if rewards are not able to be redeemed for whatever reason but specifically, in the case of a technical failure of software or hardware or an EFTPOS malfunction

1.1 The following terms and conditions apply for Sunburns “Win a Swimsuit a Week” (the “Promotion”) and by submitting an entry into this Promotion, entrants warrant that they have read, understand and agree to be bound by them.

5.2 Incorrect, false, incomplete or incomprehensible entries, at the Promoter’s sole discretion, will not be eligible.
5.3 Should an entrant’s contact details change during the Promotion Duration or prior to the date of the winner being selected, the entrant must notify the Promoter of the changed details prior to the prize being drawn. A request to view or modify any information provided in an entry may be done by contacting customer service on enquiries@sunburn.com.au.
PRIZE(s)
6.1 The weekly winner will be drawn at 9.30am every Monday at Sunburn Pty Ltd, 247 King St, Mascot, NSW, 2020. This is a game of skill as the winner will be determined by having the best response to the question, "Tell us in 15 words or less what you love about Summer".
6.2 All prize values are the recommended retail value as provided by the relevant supplier, are in Australian dollars and are correct at the time of printing.
6.2 There is one (1) prize each week to be won consisting of the following:

PRIZE CONDITIONS
7.1 If the winner does not take any part of the prize in accordance with these terms and conditions, then that part will be forfeited by the winner. Cash will not be given in lieu of any part of the prize that is forfeited.
7.2 The Promoter’s decision in relation to any issue arising from the Promotion or these Terms and Conditions, including (without limitation) timing of notifications, and eligibility or disqualification of an entrant or winner, is final and no communication will be entered into.
7.3 A purchase on any swimwear item up to the value or $200 must be made online at Sunburn.com.au with the provided voucher code. The voucher can not be redeemed at a Sunburn store.
7.4 If the value of the online purchase is over $200, the winner must pay the additional cost. Postage will be charged to the value of $9.95.
NOTIFICATION
8.1 The Promotion winner will be notified by email at the time of winning
8.2 The winner’s name may be published on www.sunburn.com.au and possibly the Sunburn Swimwear blog
8.3 The Promotion winner must claim their prize within 7 days of the email being sent. If the prize or any part of it is not
claimed by this time, that winner will be deemed to have forfeited the
prize and the Promoter will draw another winner on the following Monday at 9.30am AEST.
PUBLICITY
9.1 It is a condition of entry that the Promoter has the right to publicise the winner’s name and other agreed details for any promotion or matter incidental to the Promotion.
RELEASE AND INDEMNITY

2. 5 attendees will be presented with the opportunity to participate in Sunburn’s match up competition
3. The winner of this competition will be presented with
a. An After Hours Private Styling Session with our trained Swim Stylists
i. A private consultation and fitting session with our trained Swim Stylists
ii. Champagne and chocolates on arrival
iii. A personal shopping session with our Swim Stylists
b. $20 voucher to spend on any product at the Sunburn Chermside store
4. The winner must be at least 18 years of age in order to redeem prize
5. The winner must contact the Chermside store in order to arrange an appointment for the styling session.
6. The styling session must be redeemed outside the Chermside stores trading hours
7. The $20 vouchers and styling session must be redeemed before Saturday the 31st March 2012. After this time the winner forfeits the voucher
