This website has been developed for use by customers and intended customers.
You agree not to use the website in any way that causes or is intended to cause access to the website to be damaged, interrupted, or impaired in anyway including but not limited to:
- Causing annoyance or nuisance inconvenience or mischief;
- Fraudulent purposes or in connection with unlawful or criminal activity;
- Breach of copyright, trademarks, confidence, privacy or any other right.
Contract
When you place an order to purchase a product from Sunburn, we will send you an email confirming receipt and details of your order.
Our acceptance of this offer to purchase will be at the time we dispatch that product to you and a confirming email in this regard is sent.
The acceptance will be complete at this time. It is agreed at the time you place an order it is your intention to enter into a contract with Sunburn Co Pty Limited.
Pricing and Availability
Sunburn lists products for sale on its website as indicated. Whilst we use our best endeavors to fulfill such orders, we cannot be held responsible if the products are not available at a given point in time.
It is further noted that dispatch times indicated on our website are a guide and are not guaranteed dispatch times and should not be relied upon as such.
Pricing is shown in the currency as indicated at the time the order is accepted, and all prices are inclusive of the Goods and Services Tax.
Customs
When ordering goods from sunburn.com.au for delivery to any destination outside Australia, the recipient may be charged import duty and other taxes including, but not limited to, sales tax which are levied on import values above a threshold by the customs authority in that overseas country. It is the responsibility of the purchaser to pay these amounts to the freight company if applicable prior to delivery. It is outside our area of control and responsibility to determine, advise or influence such charges.
As customs policies vary from country to country, you are requested to direct queries of this nature to your local customs office. Customers should also note that the recipient is to be regarded as the Importer of record and you will need to comply with whatever regulations are required in this regard in the country of the recipient. Sunburn are neither able to advise on process to claim back, nor refund, any duty and taxes paid should an ordered item be returned.
Escape the Winter Blues Promotion
INTRODUCTION
1.1 The
following terms and conditions apply for Sunburns “Escape the Winter Blues (the
“Promotion”) and by
submitting an entry into this Promotion, entrants warrant that they have read,
understand and agree to be bound by them.
1.2 All entries must comply with these terms and conditions, which terms and conditions can be also viewed at the register in-store or on-line at www.sunburn.com.au (“the Website”).

PROMOTION DURATION
3.1 Entries will be taken from 9.00am (/AEST)
on Tuesday the 11th of May 2010 until 5:00pm (/AEST) on Friday, 11th
June, 2010 (the “Promotion Duration”).
4.1 Entry
is open to permanent residents of Australia.
4.2 Employees
and the immediate families of Sunburn and its related bodies are ineligible
to enter. Employees
and the immediate families of all associated sponsors and participating
Companies are also
ineligible to enter.
4.3 Entrants must enter this Promotion in a
personal capacity and not on behalf of a business or other enterprise activity.
5.1 To
enter the Promotion, an entrant must:
Instore:
(a) make a purchase
of any value in-store within the Promotion Duration;
(b) when making the
purchase, must join the SUNBURN mailing list and provide correct and complete contact information.
Online:
(a) Join the SUNBURN
mailing list and provide correct and complete contact information
5.2 Incorrect, false, incomplete or
incomprehensible entries, at the Promoter’s sole discretion, will not be
eligible.
5.3 Should
an entrant’s contact details change during the Promotion Duration or prior to
the date of
of the prize being
drawn, the entrant must notify the
Promoter of the changed details prior to the prize being drawn. A request to
view or modify any information provided in an entry may be done by contacting
customer service on enquiries@sunburn.com.au.
6.1 The prize will be drawn on Monday, 14th
June, 2010 at 247 King St, Mascot, NSW.
6.2 All prize values are the recommended
retail value as provided by the relevant supplier, are in Australian dollars
and are correct at the time of printing.
6.2 There
is one (1) prize to be won consisting of the following:

x nights’ accommodation in a one bedroom apartment at Mantra Trilogy, Cairns
Return
airport transfers in Cairns

x return, economy airfares from winner’s closest capital city to Cairns
Total maximum value
of prize: $1500 (dependant
on departure capital city
7.1 Other than those specifically referred
to above, all other costs and expenses are excluded (including, but not limited
to, the costs of transport to and from closest capital city, airport taxes,
meals, or other paid goods or services provided by the relevant prize suppliers
such as mini bar items). Such other
costs and expenses will be at the winner’s and their accompanying guest’s own
cost.
7.2 The prize and any part is subject to
availability and is non transferable, non exchangeable and cannot be redeemed
for cash.
7.3 The prize must be used within the month
of July 2010 at the specified location as outlined in these terms and
conditions. However, prizes may not be valid during school holidays or
other peak times designated by the prize supplier.
7.4 If the winner does not take any part of
the prize in accordance with these terms and conditions, then that part will be
forfeited by the winner. Cash will not
be given in lieu of any part of the prize that is forfeited.
7.5 No travel or other insurance is included
in the prize. It is therefore the
winner’s and their accompanying guest’s responsibility to take out such
insurances at their own cost.
7.6 The Promoter’s decision in relation to
any issue arising from the Promotion or these Terms and Conditions, including
(without limitation) timing of notifications, and eligibility or disqualification
of an entrant or winner, is final and no communication will be entered into.
8.1 The Promotion winner will be notified by
email at the time of winning and then by telephone and the winner’s name will
also be published on the Website on or from Monday, 14th June, 2010.
8.2 The Promotion winner must claim their
prize by 5pm on Friday, 18th June, 2010 AEST. If the prize or any part of it is not
claimed by this time, that winner will be deemed to have forfeited the prize
and the Promoter will draw another winner at 9am on Monday, 21st
June, 2010.
9.1 The Promoter will not be responsible
for any changes in times or dates, or cancellations or rescheduling of events
that may prevent the Promotion winner from redeeming the prize or any part of
it, or any change in value of the prize for whatever reason, nor in relation to
the quality of any part of the prize.
10.1 It is a condition of entry that the
Promoter has the right to publicise the winner’s name and other agreed details
for any promotion or matter incidental to the Promotion.
10.2 The winner is required by the Promoter to
provide three (3) photographs to the Promoter’s satisfaction, whilst away on
the Promotion prize, for publicity use and acknowledges that the Promoter has
the right to use such photos, the winner’s voice, name and other details as
stated above, in any medium (including, without limitation, the internet),
assigning all relevant copyright to the Promoter.
10.3 The winner, at no fee, agrees to
co-operate in any interview or other publicity requirement, allowing
photographs to be taken, and agrees for such to be published at the Promoter’s
discretion.
11.1 To the maximum extent permitted by law,
all entrants release and indemnify the Promoter from and against all liability,
costs, losses or expenses arising out of acceptance or use of any prize(s) or
participation in the Promotion, including (but not limited to) arising from the
publicity stated above, and including (but not limiting to) to loss of income,
loss of opportunity, death, personal injury and/or damage to property, whether direct, indirect
or consequential due to any act, omission, negligence or otherwise, by the
Promoter, any supplier of a prize or any person or body whatsoever related to
this Promotion.
11.2 The Promoter may vary these Terms and
Conditions for any reason, without liability to any entrant or the winner, if
the Promoter believes it is necessary to do so.
12.1 Obtaining time off work and/or study or
related activities to participate in the prize or the publicity, will be the
cost, and sole and absolute responsibility, of the promotion winner.
13.1 If the prize winner is under the age of 18
years, the prize winner must travel with a parent or guardian as their guest
for the prize. The Promoter is not
responsible for any additional costs in relation to this obligation.
14.1 A
failure by the Promoter to enforce any one of these terms and conditions in any
circumstance will not
give rise to any
claim or right of action by any other person and will not be considered a
waiver of that term or condition.
15.1 The
personal information supplied by entrants when entering this Promotion will be
used by the
Promoter in
accordance with these terms and conditions and its Privacy Policy. Please refer to the Privacy Policy by
visiting the Website. Entrants in this
Promotion agree to be bound by that Privacy Policy. All

Consent
Sunburn.com.au assumes all sales are made to persons over the age of 18. If you are under 18, you need to have the involvement of a parent or guardian.
Payment
Payment is only accepted by means of the credit card types as shown. We are unable to process any other payment form.
Alterations to terms and conditions
We reserve the right to make changes to our website, policies, terms and conditions at any time.
Waiver
Should you breach any terms or conditions and we take no action against you, we shall be entitled to invoke our rights and remedies in any other situation where you breach these conditions.
Governing Law
The above terms and conditions are governed by the laws applicable of the state of New South Wales in Australia.
Both parties submit to the non exclusive jurisdiction of the New South Wales Courts.
